Dangerous & Defective Products / Products Liability FAQs
Question:
What is Product Liability Law?
Answer:
Product Liability is the law that applies when injury or damage occurs because of a defect in a product. In Louisiana, the statutes that primarily describe product liability claims are known as the Louisiana Products Liability Act. Those laws are cited as Louisiana Revised Statutes 9:2800.51 through 9:2800.60. Read the act
Question:
What are some examples of product liability claims?
Answer:
Although any product that causes injury or damage can be defective and justify a product liability claim, some common examples are a dangerous condition in a vehicle such as a seat belt that fails in a collision, an industrial device with moving parts and an inadequate guard to stop fingers or hands from being drawn into the machine, and a toy that does not warn that its small parts present a chocking hazard to infants.
Question:
What types of defects may allow me to assert a product liability claim?
Answer:
In Louisiana, a product may be defective if it is unreasonably dangerous in manufacturer or construction, design, inadequate warning, and/or breach of an express warranty.
Question:
If you think you may have been injured because of a defective product, what should you do with the product?
Answer:
It is always very important to preserve the product involved in an accident so that a determination can be made as to whether it is defective and the cause of those defects. Disassembly, repair, or loss of the product may end any chance of success in a product liability claim. Of course, any product which may be unreasonably dangerous should be removed from use and made safe so that no other injuries occur.
